Terms and conditions
Updated: 15 September 2026
1. Provider and scope
These terms cover printing, finishing and personalisation orders with Peng Commerce GmbH, Hansaallee 190, 40547 Düsseldorf, trading as XPrint. They apply to consumers and business customers where validly incorporated into the relevant contract. Individually agreed terms take priority.
2. Enquiries, quotations and contracts
The website and calculator support product selection and quote requests. Configuring, saving or submitting an enquiry does not by itself place a paid order. An automatic receipt notification does not accept an order.
A contract arises through matching declarations, for example when you accept a binding quotation within its validity period or we expressly confirm your order. The agreed specification, quantity, price and confirmed deadline govern the order.
3. Prices and payment
Prices and payment terms follow the individual quotation or order agreement. Net prices and VAT are identified; for consumers, the total price including VAT is relevant. Delivery, express, design and other additional charges are stated before the contract is concluded and charged only where agreed.
Advance payment or a deposit is required only if agreed. Payment dates and methods follow the agreement and otherwise the applicable statutory rules. Statutory rights to withhold payment and set off claims remain unaffected.
4. Artwork and customer information
Please provide the agreed files and specifications, including size, material, quantity and, where relevant, textile print position, colour and garment size. You must hold the rights needed for the commissioned use of any logos, images, fonts and text you provide.
Technical file checking covers only the agreed scope. Content correction, proofreading, design and additional checks require a separate agreement. We will point out problems we identify. Our own contractual duties of care and checking remain in place.
Where several file versions exist, we agree which version is to be produced. Sending a new file does not automatically replace an approved version. Changes after approval require agreement on feasibility, cost and timing, followed by renewed express approval before producing the revised version.
For garments or other items supplied by you, we agree the material, condition, quantity and intended treatment in advance. Please disclose known characteristics, such as coatings or sensitivity to heat. If a test item is needed, we agree its use, possible alterations and costs before testing. Identifiable limitations are discussed before processing; our statutory and contractual duties remain in place.
5. Proofs and production approval
Where a proof or production approval is agreed, the relevant production starts only after your express approval. Silence does not constitute approval. Please check content, dimensions, page order and positioning in particular.
Screen previews, material photographs and AI product mockups provide guidance. The result is governed by the agreed characteristics and any agreed binding sample. Approval does not exclude claims arising from our production errors or other deviations for which we are responsible.
If colour, feel or a particular finish is essential, we discuss before production whether a physical sample, colour proof or test print is needed. Its scope, cost and the characteristics for which it is binding are expressly agreed. A digital artwork proof does not automatically confirm the colour or material appearance of the finished product.
6. Changes and cancellation
Please notify us promptly if you wish to change or cancel an order. We will clarify whether the change is still possible and on what terms. Additional services and price changes require agreement.
Payment and refunds when an order ends follow the agreement and the statutory rules for the relevant contract. Statutory withdrawal, termination and cancellation rights are not restricted by these terms. No flat cancellation fee applies.
7. Production, delivery and collection
Production and delivery dates are agreed for each order. Express service applies only when expressly confirmed. If required files, an agreed approval or an agreed advance payment are missing, we will discuss the effect on the schedule with you.
When agreeing dates, we distinguish completion or dispatch from arrival at the delivery address. Please state any required event date when making your enquiry. We confirm in the quotation or order agreement whether delivery by that date is possible. This does not restrict an already agreed binding delivery deadline.
Collection follows notification that the order is ready and arrangement of a collection time. Shipments use the agreed address and shipping method. Risk passes under the applicable law, including statutory consumer protection for shipments. We will inform you of foreseeable delays. Statutory remedies for late delivery remain unaffected.
8. Product quality and defects
Products must meet the agreed and legally required characteristics. These terms do not grant a blanket exemption for colour, dimension or quantity differences. Please agree special requirements, such as binding spot colours, outdoor use or material properties, before concluding the contract.
Please send complaints to info@x-print.biz with the order reference and a description, preferably with photographs. Statutory rights relating to defects remain in place. Consumers do not lose their rights solely by failing to report a defect immediately. Applicable statutory inspection and notification duties for merchants remain unaffected.
9. Consumer withdrawal rights
Statutory withdrawal rights are not excluded across the board. For distance contracts concerning goods made according to a decisive individual selection or clearly tailored to personal needs, the exception in Section 312g(2)(1) BGB may apply. Examples can include products printed or engraved with your own artwork.
Standard goods and services require separate consideration of whether withdrawal rights apply and under which rules. Calling an order a printing order or requesting express service does not automatically remove an existing withdrawal right. Rights relating to defects also remain for personalised goods.
10. Liability
Our liability follows the applicable statutory rules. These terms impose no blanket exclusions or maximum limits on liability.
11. Content rights and reference images
You permit us to use supplied content only to the extent needed for the agreed processing and production. Any additional rights, including rights to designs we create, follow the individual agreement.
Publishing your artwork, logos or order photographs for advertising or reference purposes requires separate permission. Placing an order alone does not provide that permission. Our privacy policy explains how we process personal data.
12. Applicable law and disputes
German law applies. Mandatory protections under the law of a consumer’s habitual residence remain unaffected where applicable. No exclusive court jurisdiction is imposed on consumers.
We are not willing or obliged to participate in dispute-resolution proceedings before a consumer arbitration board. For order-related questions, contact info@x-print.biz or +49 211 97537110.
